This document sets out the Terms and Conditions applicable to enrollment in the Academy's programs. It comprises two parts, each constituting a separate and independently binding agreement applicable to the relevant program:

Part A — Terms and Conditions for the One-on-One (1:1) Private Tutoring Program

Part B — Terms and Conditions for Group Classes.

A Parent enrolling the Student in a particular program is bound by the Part of these Terms applicable to that program. Where a Student is enrolled in, or switches between, both programs, the relevant provisions of each applicable Part shall apply concurrently.

PART A — ONE-ON-ONE (1:1) PRIVATE TUTORING PROGRAM

These Terms and Conditions (“Terms”) set out the terms upon which Little Genius Academy (“the Academy”, “we”, “us”, or “our”) agrees to provide one-on-one (1:1) private tutoring services to the student (“the Student”) enrolled by the undersigned parent or legal guardian (“the Parent”, “you”, or “your”). By making payment towards enrollment in the Academy's 1:1 program, the Parent acknowledges having read and understood these Terms and agrees to be bound by them, and these Terms shall thereupon constitute a legally binding agreement between the Parent and the Academy under the Indian Contract Act, 1872.

Definitions
  • In these Terms, unless the context otherwise requires:
    • “Academy” means Little Genius Academy, including its authorized representatives, teachers, and staff;
    • “Parent” means the parent or legal guardian who enrolls the Student and who shall be responsible for all obligations under these Terms on behalf of the Student;
    • “Student” means the child enrolled in the Academy's 1:1 program;
    • “Session” means a single scheduled 1:1 class conducted between the Academy's teacher and the Student;
    • “Package” means the bundle of Sessions purchased by the Parent, as reflected in the applicable fee structure.
Class Cancellation Policy
  • The Parent shall notify the Academy of any cancellation of a scheduled Session at least six (6) hours prior to the scheduled start time of such Session.
  • Any cancellation notified less than six (6) hours prior to the scheduled start time shall be treated as a completed Session and shall be deducted from the Package accordingly.
Fee Payment Policy
  • All fees paid towards a Package shall be non-refundable and non-transferable, irrespective of the reason therefor, including but not limited to a change of mind, discontinuation of the program, relocation, or a change in the Student's availability.
  • Fees paid towards one Student's Package shall not be applied, adjusted, or transferred towards any other student, sibling, program, or Package.
  • The Academy reserves the right to revise its fee structure at its discretion, from time to time. Any Package for which payment has already been received shall be honored in full in accordance with the fees applicable at the time such payment was made. Any revised fees shall apply only to Packages purchased subsequent to such revision, and the Academy shall provide the Parent with reasonable advance notice of any such revision.
Payment Portal Terms
  • Payment made through the payment link provided by the Academy shall constitute the Parent's acceptance of these Terms.
  • Accepted modes of payment include credit card, debit card, Unified Payments Interface (UPI), and net banking. Equated Monthly Instalment (“EMI”) options may be made available, subject to the Parent's eligibility and the terms of the relevant payment service provider.
  • The Academy shall not be liable for, and does not assume any responsibility in respect of, any unauthorized interception, hacking, or other unauthorized access to the Parent's payment information during the course of the payment process.
Validity of Sessions
  • Packages comprising seventy-two (72) Sessions shall be completed within a maximum validity period of eleven (11) months from the date of commencement.
  • Packages comprising thirty-six (36) Sessions shall be completed within a maximum validity period of five (5) months from the date of commencement.
Recommended Schedule
  • The Academy recommends the following weekly schedule for its respective programs:
    • English Enrichment Program: two (2) hours per week, or one (1) hour twice a week;
    • Reading Circle: two (2) Sessions of forty-five (45) minutes each, per week;
    • Mathematics: two (2) to four (4) Sessions per week.
Fixed Time Slots
  • Each Student shall be assigned a fixed time slot for regular Sessions.
  • Any request for Sessions outside the Student's standard fixed time slot shall be subject to teacher availability and cannot be guaranteed.
Admission After Demo/Diagnostic Test
  • Following the demo or diagnostic test Session, admission shall be confirmed within three (3) days.
  • In the event admission is not confirmed within the aforesaid period, the Academy reserves the right to offer the relevant slot to another student, and the same slot shall thereafter not be guaranteed to the Parent.
  • Admission shall be deemed confirmed only upon receipt by the Academy of the applicable fee, paid in full.
Class Timings and No-Show Policy
  • All Sessions shall commence and conclude strictly in accordance with the scheduled time. The Academy shall not be obliged to extend any Session beyond its scheduled end time on account of a delayed start.
  • In the event the Student has not joined a Session within five (5) minutes of its scheduled start time, the assigned teacher shall attempt to contact the Parent by telephone call and/or message. If the Student has still not joined the Session upon expiry of the said five (5) minute period, the teacher shall conclude the Session, and such Session shall be recorded as a no-show and treated as a completed Session, to be deducted from the Package in accordance with Clause 2.
  • If, subsequent to the teacher's exit from the Session under Clause 9.2, the Parent contacts the Academy and confirms that the Student is available to join, the teacher shall rejoin the Session and conduct the same for the remaining duration only. Notwithstanding such rejoining, the Session shall conclude at its originally scheduled end time and shall not be extended, and the Student shall accordingly receive instruction only for the period between the time of rejoining and the originally scheduled end time.
Time Zone and Daylight Saving Policy
  • All Sessions shall be scheduled in accordance with Indian Standard Time (“IST”) and shall remain fixed by reference thereto throughout the duration of the program.
  • For Parents and Students located in jurisdictions observing Daylight Saving Time (“DST”), Session timings shall continue to be governed by IST and shall not be adjusted to account for DST.
Program Start Date
  • The Academy shall communicate the program start date to the Parent following successful receipt of the applicable fee.
  • The Parent acknowledges that Sessions may take up to seven (7) days to commence, as scheduling is finalized subject to teacher availability and slot allocation.
Study Material Policy
  • All learning material, worksheets, and resources provided by the Academy in connection with the program are, and shall remain, the intellectual property of the Academy, and are provided solely for the personal use of the Student.
  • The Parent shall ensure that such material is not photocopied, photographed, reproduced, or shared, in any form or by any means, with any person outside the Student's immediate family, including via social media or other platforms.
Physical Learning Material and Shipping
  • Where the Parent has opted for physical learning material, the Academy shall arrange for such material to be shipped to the address provided by the Parent. Save where the Parent elects to proceed under Clause 13.2, Sessions shall commence only upon the Parent's receipt of the physical learning material.
  • Where the Parent wishes to commence Sessions prior to receipt of the physical learning material, whether on account of a shipping delay or otherwise, the Academy shall, at the Parent's request, provide a digital (PDF) copy of the relevant learning material, which the Parent may print for the Student's use so that Sessions may commence without awaiting delivery of the physical material.
  • Where the Academy determines, following enrollment, that shipping of the physical learning material to the Parent's location is not feasible, the Academy shall offer the Parent either of the following, at the Parent's election: (a) a reduction of ten percent (10%) of the total fee paid, representing the cost of the physical learning material and shipping, together with a digital (PDF) copy of the learning material for the Parent to print and use; or (b) a full refund of the fees paid, on account of the Academy's inability to fulfil the physical material component of the Package.
Teacher Availability and Rescheduling
  • In the event the Student's assigned teacher is unavailable for a scheduled Session, the Academy shall inform the Parent at least twenty-four (24) hours in advance, save in cases of genuine emergency.
  • The affected Session shall be rescheduled at no additional cost to the Parent. Where a suitable time for rescheduling cannot be arranged within the same week, the Academy shall extend the validity of the Package by one (1) week to accommodate the make-up Session.
Recording and Media Consent
  • The Parent consents to Sessions being recorded by the Academy for internal quality review, training, and reference purposes. Such recordings shall be used solely by the Academy and shall not be shared publicly or with any third party without the Parent's prior consent.
  • The Parent further grants the Academy a non-exclusive, royalty-free license to use photographs, videos, and audio recordings of the Student, captured during Sessions or Academy events, for promotional and marketing purposes, including on the Academy's website, social media platforms, and other marketing material. A Parent who does not wish to grant such permission shall notify the Academy in writing at the time of enrollment.
Switching from Group Classes to 1:1 Private Lessons
  • Where a Student switches from the Academy's group class program to the 1:1 program, only thirty percent (30%) of the fees attributable to the remaining, unused group Sessions shall be adjusted towards the 1:1 program.
  • The balance amount shall be payable in accordance with the fee structure applicable to the 1:1 program.
  • No further adjustment or refund shall be applicable in respect of fees paid towards the group class program.
Limitation of Liability
  • Save as expressly set out in these Terms, the Academy's aggregate liability to the Parent in respect of the program shall not exceed the fees actually paid by the Parent for the Package in question.
  • The Academy shall not be liable for any indirect, incidental, or consequential loss or damage arising out of or in connection with the program.
Force Majeure
  • The Academy shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay arises from causes beyond its reasonable control, including but not limited to acts of God, natural disaster, pandemic, government action, or internet or power outage.
Notices
  • Any notice or communication required to be given under these Terms shall be deemed validly given if sent to the Parent's registered email address, phone number, or WhatsApp number on record with the Academy, or to the Academy's official contact details published on its website.
Amendment
  • The Academy reserves the right to amend or revise these Terms at any time. The revised Terms shall take effect upon publication on the Academy's website, and the Parent's continued enrollment in the program following such publication shall constitute acceptance of the revised Terms.
Waiver
  • No failure or delay by the Academy in exercising any right under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any other or further exercise of that or any other right.
Severability
  • If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.
Entire Agreement
  • These Terms constitute the entire agreement between the Parent and the Academy in relation to the 1:1 program and supersede all prior understandings, whether written or oral, relating to the subject matter hereof.
Governing Law and Dispute Resolution
  • These Terms shall be governed by and construed in accordance with the laws of India.
  • The parties shall endeavor to resolve any dispute arising out of or in connection with these Terms amicably. In the event such dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts at Vadodara, Gujarat.

We appreciate the Parent's understanding and cooperation in maintaining a structured and effective learning environment.

PART B — GROUP CLASSES PROGRAM

These Terms and Conditions (“Terms”) set out the terms upon which Little Genius Academy (“the Academy”, “we”, “us”, or “our”), a brand and trading name of Thinkspire Education Private Limited, agrees to provide group tutoring services to the student (“the Student”) enrolled by the undersigned parent or legal guardian (“the Parent”, “you”, or “your”). By making payment towards enrollment in any of the Academy's group programs, the Parent acknowledges having read and understood these Terms and agrees to be bound by them, and these Terms shall thereupon constitute a legally binding agreement between the Parent and the Academy under the Indian Contract Act, 1872.

Definitions
  • In these Terms, unless the context otherwise requires:
    • “Academy” means Little Genius Academy, a brand and trading name of Thinkspire Education Private Limited (“TEPL”), including its authorized representatives, teachers, and staff;
    • “Parent” means the parent or legal guardian who enrolls the Student and who shall be responsible for all obligations under these Terms on behalf of the Student;
    • “Student” means the child enrolled in the Academy's group program;
    • “Session” means a single scheduled group class conducted by the Academy, whether Online or Offline;
    • “Term” means each of the two academic terms comprising the Academy's academic year, being 1st April to 30th September (“Term 1”), and 1st October to 31st March (“Term 2”);
    • “Level” means the proficiency level or grade at which a Student is placed within a Program, as determined by the Academy's Level Test;
    • “Program” means the course or curriculum in which the Student is enrolled;
    • “Level Test” means the mandatory admission and/or periodic evaluation test administered by the Academy to determine or review a Student's Level.
Admission
  • The academic year shall run from 1st April to 31st March, comprising two Terms as set out in Clause 1(e).
  • Admission to the Academy is subject to the Student appearing for a mandatory Level Test, which may be conducted Online or Offline, at the Parent's convenience. Admission shall be granted only into the Level determined by the Student's performance in the Level Test.
  • The Parent shall ensure that the Student is well-rested and adequately prepared to attempt the Level Test. The Level Test shall not be retaken by the Student for any reason whatsoever.
  • Where a Parent wishes to enrol the Student into a Level not advised by the Academy's centre head, the Parent shall be required to sign an undertaking to that effect.
  • A course progression outline may be prescribed to the Parent at the time of admission, setting out the pattern of classes the Student is expected to take over a specified period. A Parent wishing to deviate from such outline, including mid-Term or mid-period, shall be required to sign an undertaking to that effect.
  • Where a Parent pays the applicable fee prior to the Student undergoing the Level Test, the Student shall nonetheless be required to undergo the Level Test. Once a Level has been advised, the Academy shall not be responsible for fees already paid where a vacancy is unavailable in the desired batch; in such event, the Parent may elect not to continue with the advised Level or batch, subject to signing an undertaking for opting into a batch or Level not so advised. No refund of fees shall be made on the ground that the resulting timings are unsuitable to the Parent.
  • Where a Parent pays fees for more than one course without the Student having undergone the Level Test for one or more of such courses, the Student shall nonetheless be required to undergo the Level Test for each such course. Where the batches for the resulting advised Levels clash, the Academy shall bear no responsibility for such clash, and no fees shall be refunded on that account. A Parent wishing to opt for a non-clashing batch at a Level other than that advised shall be required to sign a declaration or undertaking to that effect.
  • No admission to any batch or centre shall be confirmed without receipt by the Academy of the applicable fee, paid in full.
  • The Academy may reschedule a Session as and when it deems necessary. Intimation of any such rescheduling shall be provided in accordance with Clause 19 (Official Communication Channels).
  • Admission to all batches shall be granted on a first-come-first-served basis.
  • The Parent shall ensure that the Student attends the batch specified on the Student's final fee receipt, and shall be responsible for the accuracy of the details set out on such receipt.
  • Batch transfers are subject to availability and to the discretion of the Academy's management. A confirmed batch or class timing may not be changed by the Parent except upon completion of the procedure prescribed by the Academy's administrative department, and with the Academy's prior permission.
  • A batch transfer shall be granted only upon: (a) submission of a batch-transfer request form (whether Online or Offline); (b) availability of a seat in the preferred batch; and (c) presentation of the Parent's original admission receipt. No more than one such transfer shall be permitted per Student, per academic year.
  • All rights in respect of admission are reserved by the Academy.
  • The Academy reserves the right to cancel the admission of the Student immediately upon any misbehaviour or non-adherence to these Terms on the part of the Parent, guardian, or Student, including mid-Term and notwithstanding that Sessions remain outstanding. The Parent/guardian shall have no claim to a refund in such event, and the decision of the Academy's Directors in this regard shall be final.
  • Where a Parent considers that the Student is finding the syllabus or course either too difficult or too easy, the Parent may request a revaluation of the Student. A minimum gap of six (6) months shall be maintained between successive revaluation requests made in respect of the same Student.
  • The Academy may require Parents to select a batch from options made available to them, in accordance with a process and deadline determined by the Academy. A Parent who does not complete this process by the stipulated deadline shall be assigned a batch selected by the Academy, and no further change shall thereafter be permitted.
  • Where a Parent is unable to secure the Student's desired batch, the Parent may elect to place the Student on a waitlist; placement on a waitlist does not guarantee a seat in the relevant batch. Preference on any such waitlist shall first be given to Students already enrolled with the Academy, and thereafter to waitlisted prospective Students in the order in which their requests were received.
Fees and Payments
  • All fees are non-negotiable, non-transferable, and non-refundable.
  • The fee applicable to a Program is the same whether the Program is availed in Online or Offline mode. A Student switching between Online and Offline delivery of the same Program and Level shall not be required to pay any fee differential on account of such switch, subject always to availability of a seat in the desired batch and to Clause 21 (Force Majeure, Pandemic, and Emergency Provisions).
  • Where a Student switches to a Level for which a higher fee is applicable, the Parent shall pay the difference between the fee already paid and the fee applicable to the new Level. Where such a switch occurs mid-Term, the Parent shall additionally pay the fee applicable to a new workbook and kit for the revised Level, in accordance with the prevailing fee schedule, as the workbook and kit corresponding to the Student's original Level shall already have been procured and printed.
  • The fee applicable to a Program may vary by region, including for international Students.
  • Once a fee, or part thereof, has been paid towards a Term, it cannot be converted into payment towards an annual (full-year) Package.
  • Admission to Online classes shall not be deemed a guarantee of admission to Offline classes.
  • A duplicate copy of any receipt may be downloaded by the Parent at any time through the Academy's online payment portal.
  • The receipt issued by the Academy in respect of a fee payment shall be retained safely by the Parent for future reference, and the Parent may be required to produce the same at any point during the academic year. A fee structure and details sheet shall be provided to the Parent at the time of admission.
  • The Academy reserves the right to discontinue any trial, promotional offer, or complimentary service or good, at any time it deems necessary.
  • The Academy reserves the right to alter the fee structure applicable to any Session, class, or course.
  • Payment for a given Term entitles the Student to attend only the Sessions comprised within that Term, as set out in the Schedule of Modules below. A Student joining after a Term has commenced may avail recordings of missed Sessions for that Term in accordance with Clause 9 (Alternate and Recorded Sessions); no discount on the Term fee shall be provided on account of such missed Sessions. The Academy shall not permit a Student to attend a Session where the applicable fee has not been paid; such Student shall be required to wait in the designated waiting area until the outstanding dues are cleared.
  • All refunds, where applicable, shall be made only by bank transfer, regardless of the original mode of payment.
  • The Parent shall ensure that payment is made for the correct number of sessions and the correct Term. Where a Parent mistakenly pays for an incorrect Term or an incorrect number of sessions, no refund or transfer of the fee so paid shall be provided.
  • The Academy may, from time to time, offer existing Students an “Early Bird” fee for enrollment in the next academic year, applicable only where payment is received on or before a stated cut-off date (the “Early Bird Date”).
  • The Early Bird Date is strictly enforced. No extension, exception, or grace period shall be granted under any circumstances, and payment received after the Early Bird Date shall be charged at the fee structure then prevailing (the “Revised Fee”), irrespective of the reason for the delay.
  • Where a Parent pays the fee for one Term at the Early Bird rate before the Early Bird Date, but the fee for a subsequent Term is paid after the Early Bird Date has passed, the fee for such subsequent Term shall be charged at the Revised Fee, and the Early Bird rate shall not carry over to that subsequent Term.
  • The Early Bird rate applies equally to trial classes (“Demos”) under Clause 15. Where the fee for a Demo is paid before the Early Bird Date, but the fee for admission following such Demo is paid after the Early Bird Date has passed, the post-Demo admission fee shall be charged at the Revised Fee.
  • All fees stated by the Academy are inclusive of applicable Goods and Services Tax (GST); no additional GST or other tax shall be levied over and above the stated fee.

Payment Portal Terms
  • Fees are non-negotiable, non-transferable, and non-refundable.
  • Payment shall be made only through the payment link provided by the Academy. Payment made through such link shall constitute the Parent's acceptance of these Terms.
  • Payment through the portal may only be made using a credit card, debit card, UPI, or net banking; certain net banking features may be unavailable through this mode. The Parent is advised to make independent enquiry with the relevant card issuer or bank regarding any charges applicable to such payment.
  • The service is provided through a secure payment gateway; however, neither the payment gateway provider nor the Academy warrants that information provided online is secure from interception by third parties. The Academy shall not be liable for any unauthorized interception, hacking, or other unauthorized access to information provided by the Parent in the course of using this service.
  • The Academy and its employees shall not be liable to the Parent for any loss or damage arising from the Parent's use of, or reliance upon, information on the Academy's website, or from any failure to comply with these Terms where such failure arises from insufficient funds being available on the Parent's nominated card or bank account at the time of payment.
  • The Academy shall not be liable for any damage, loss, cost (including legal costs), expense, or indirect or consequential loss of any kind suffered or incurred by the Parent arising from use of this service.
  • The Academy may, in certain cases, offer the Parent the option to pay by Equated Monthly Instalment (“EMI”), with flexibility as to the period over which such instalments are paid. The Parent's bank shall be responsible for any error or omission occurring in the processing of such instalments; the Academy shall bear no responsibility in this regard.
  • Fees once paid shall not be refunded under any circumstances, save as may be expressly provided elsewhere in these Terms.
  • Upon successful payment, a receipt shall be automatically emailed to the address provided by the Parent at the time of payment. The Parent may additionally retain a screenshot of the payment confirmation, and may separately download the receipt from the payment portal at any time in accordance with Clause 3.7.
  • The Parent warrants that any debit or credit card details provided are correct and accurate, and that the card used is lawfully owned by the Parent, or that its use is duly authorized by its lawful owner. The Parent authorizes the debit of the nominated card or bank account for the fees selected, and shall ensure that sufficient funds or credit are available for this purpose.
  • The Academy may add, delete, or alter the services offered through the payment portal, and may withdraw such service, at its sole discretion and without prior notice. The Academy also reserves the right to change the terms applicable to online fee payment without prior notice.
  • The Parent shall read the information provided on the payment page thoroughly before making payment. The Academy shall not be responsible for any misunderstanding arising from the Parent's misinterpretation of such information.
Cash Payment at Centre
  • Fees are non-negotiable, non-transferable, and non-refundable.
  • Parents are strongly advised to complete the Level Test before paying fees; where a Parent fails to do so, the provisions of Clause 2 (Admission) shall apply.
  • Fees may, in the alternative, be paid in cash at the Academy's centres. Cheques shall not be accepted as a mode of payment under any circumstances.
  • Cash payments may be made at a centre during its operating hours of Monday to Saturday, 2:00 PM to 7:30 PM.
  • The Parent shall bring the exact amount of cash due; payments shall not be accepted otherwise, and no change shall be provided at the centre.
  • For dues not cleared within the stipulated period, the admission of the Student shall automatically stand cancelled, and any part-payment made shall be forfeited, with no claim by the Parent for refund of, or deduction from, fees on that account.
  • The Academy reserves the right to close any centre for fee payment at any time, at the sole discretion of its Directors.
Part-Payments
  • The Parent may avail the option of part-payment of fees, where offered. The amounts applicable to part-payment are fixed and non-negotiable.
  • It shall be the Parent's responsibility to clear outstanding dues within the stipulated time; the Academy shall not be obliged to remind the Parent of such dues.
  • Where pending dues are not cleared within the stipulated period, the admission shall be deemed to have lapsed, and the amount already paid shall be forfeited. To continue the admission thereafter, the fee shall be payable afresh, in accordance with the fee structure then prevailing.
  • The Academy reserves the right to withdraw the option of part-payment at its sole discretion.
Attendance
  • The Parent shall ensure that the Student attends Sessions regularly.
  • In the event of a missed Session, no make-up class shall be conducted. The Parent may, subject to submission of the requisite form, avail a recorded version of the missed Session in accordance with Clause 9 (Alternate and Recorded Sessions). Where residual doubts remain after viewing such recording, the Student may book a tutoring session in accordance with Clause 14 (Tutoring Sessions).
  • The Parent shall ensure that the Student attends Sessions on time. Where a Student arrives late to a Session, the content already covered shall not be repeated, so as to avoid loss of learning to the other Students in the batch.
Online Classes
  • Where a Student or Parent is found to have wrongfully facilitated any person who is not enrolled with the Academy to attend a Session, the Student's admission shall be immediately terminated, with no claim to any refund.
  • A Student or Parent whose admission has already been terminated, and who is subsequently found attending an online Session, shall be liable to prosecution for cybercrime to the fullest extent of the law; the Parent shall be responsible for any such conduct.
  • The schedule of a Session may be changed without prior notice; any such change shall be communicated to the Parent by email in accordance with Clause 19. The Academy shall attempt, but does not guarantee, to accommodate the Student's batch-timing preference.
  • A Session may be rescheduled where a technical difficulty arises prior to, or during, the Session.
  • A Student admitted to Online classes may attend an Offline Session upon payment of an additional charge, payable in advance; details of such charge are available from the Academy's administrative department.
Alternate and Recorded Sessions
  • A maximum of two (2) complimentary requests for a recorded alternate Session shall be permitted per Term, per admission into a Program.
  • A request for a recorded Session shall be made by the Parent by submitting the prescribed form available on the Student's Google Classroom, specifying (a) the module number of the Session for which a recording is sought, and (b) the date on which the Parent wishes the recording to be made available on the Student's Google Classroom.
  • The date specified under Clause 9.2(b) shall be at least seventy-two (72) hours from the date of submission of the request. A request may only be made in respect of a Session that has already been conducted; where the Session in question has not yet taken place as of the date of the request, the date specified by the Parent shall not apply, as no recording can exist for a Session that has not been conducted, and the Academy shall process the request only once the Session has been conducted and a recording becomes available.
  • Requests beyond the quota set out in Clause 9.1 shall be chargeable, in accordance with the fee schedule applicable for that year; no additional recorded Session shall be provided without such payment. A recorded Session cannot be adjusted or carried across Programs or Terms.
  • A recorded Session consists of the recording of an actual Session conducted Online; the Academy does not provide separately recorded sessions. The Academy does not otherwise conduct separate alternate or cover-up sessions for missed classes.
  • A recorded Session shall be available for viewing for twenty-four (24) hours from the time it is made available. Where the Student fails to view the recording within this period, a fresh request must be submitted, which shall count towards the Term's quota under Clause 9.1.
  • While the Academy will attempt to accommodate the Parent's requested date and timing preferences under Clause 9.2, it does not guarantee that every request can be fulfilled precisely as requested, and processing of a request may in some cases take longer than the minimum notice period set out in Clause 9.3.
Recorded Sessions for International and Day-School Students
  • The Parent shall inform the Academy, by way of the prescribed form, of the timing at which recorded Sessions are to be sent.
  • During the winter season, a Parent may request recorded Sessions by informing the Academy, through the prescribed form, of the date on which the season begins and the date on which such recorded Sessions should cease.
  • Recorded Sessions shall be sent two (2) days after the corresponding Online class, at a designated time, and shall be available for twenty-four (24) hours only. The timing of dispatch cannot be altered at the Parent's request, and once commenced, the schedule of dispatch cannot be paused, interrupted, or restarted.
  • The Student must view the recorded Session within the twenty-four (24) hour period; the same recording shall not be resent once it has expired.
  • All recorded Sessions in respect of a given academic year must be availed before 31st March of that year; no recorded Session shall be sent after that date.
Online Class Applications
  • The Parent shall ensure that the applications required for online classes are downloaded and functioning on the Student's device, namely Google Mail, Google Meet, Google Calendar, and Google Classroom.
  • The Academy primarily conducts Sessions through Google Meet, but may change the platform used for conducting Sessions, or for other purposes, at any time and without prior notice. Any such change shall be communicated to the Student's registered email address.
  • The Academy provides telephonic and home-visit troubleshooting services at an additional charge; the Parent may contact the Academy's administrative department to avail these services.
  • The Academy may use the email address provided at admission to send information, learning material, and other communications. Where a Parent is unable to receive such communication on the registered email address, the Parent may request that an alternate email address be used; this change may only be made once.
  • Students shall be permitted to attend Sessions only through their registered email address. A Student attempting to access a Session through any other email address shall be blocked; repeated such attempts shall result in permanent termination of admission.
  • A link is not sent for each Session; the Parent/Student must click the video-camera button within the relevant application to join.
  • Sessions commence on time, and it is the Parent's responsibility to ensure the Student attends the full Session with the required study material. Content missed on account of late arrival shall not be repeated, as the learning of the other Students in the batch cannot be compromised on account of one Student.
  • The Academy expects the Student to have a stable internet connection. The Academy shall not be obliged to re-conduct a Session where a Student misses any part of it on account of poor internet connectivity or an electricity failure on the Student's end; it shall be the Parent's sole responsibility to arrange for the Student to make up any resulting missed work.
  • The Academy requires that a parent, elder sibling, or guardian remain seated alongside a Student between 3.5 and 8 years of age, to ensure optimal learning.
  • The Parent shall ensure appropriate internet connectivity. Where sound or video issues arise during a Session, the Parent/Student may attempt to log out and log back in.
  • A Student may be removed from the Academy's Google Classroom on account of non-payment of dues, and shall not be readmitted until such dues are cleared.
Inside the Meeting Room
  • Students must log in at least fifteen (15) minutes prior to the scheduled start time of a Session, during which a countdown timer shall run; the Student's microphone must be muted by the end of this period.
  • The Academy recommends that Parents keep an alternate internet connection, and a secondary device, on standby in the event of failure of the Student's primary network, device, or power supply.
  • The Student's microphone must be on mute prior to login, and shall remain muted for the duration of the Session unless the teacher directs otherwise; the Student shall not use the “Present Now” function without the teacher's direction. A Student found to be unmuted without direction may be removed from the Session and may not be readmitted to that Session.
  • A Student removed from a Session shall be required to contact the Academy to clarify the reason for such removal.
  • Students are not permitted to use the chat function, which is reserved for use by the teacher or administrator, save where the class monitor specifically requests the Student's full name to be entered in the chat box. A Student or Parent otherwise using the chat function shall be removed from the Session.
  • The Student's video must remain switched on for the entire duration of the Session; a Student whose video is found to be off shall be immediately removed from the Session.
  • A Parent seated with the Student during a Session must be appropriately attired, having regard to the presence of minor Students in the Session; a Parent found inappropriately dressed shall be removed.
  • The Session link must not be opened on two devices simultaneously; the Academy shall permanently block the Student's access in such event, which may also result in termination of admission. The Session link must not be forwarded to any other email address; access shall not be granted to any address not present in the Academy's database of registered addresses.
  • Instructions issued to Parents on-screen during a Session are mandatory and must be followed.
Offline Classes
  • It is the Parent's responsibility to ensure that the Student arrives at, and is picked up from, an offline Session on time, in accordance with Clause 18 (Pickup and Drop-off).
Tutoring Sessions
  • The Academy conducts live online tutoring sessions for the clarification of doubts.
  • Two (2) complimentary tutoring sessions are available per admission, per Program, per Term; further sessions shall be chargeable in accordance with the fee schedule for that academic year.
  • The duration of each tutoring session is restricted to fifteen (15) minutes, save where the teacher determines that an extension is necessary.
  • The Parent shall submit the Academy's prescribed form to avail a tutoring session.
  • Tutoring sessions are conducted subject to tutor availability; the Academy does not guarantee a particular time or date, but shall endeavor to identify a mutually agreeable time.
  • It shall be the Parent's responsibility to ensure the Student attends a scheduled tutoring session; the Academy does not guarantee a rescheduled session where the Parent cancels an already-scheduled session.
  • A tutoring session shall under no circumstances be considered a regular class; its purpose is limited to resolving doubts and clarifying topics already taught.
  • A tutoring session requested to resolve a doubt arising from school (as opposed to the Academy's own curriculum) must be requested at least three (3) days in advance, with all relevant information, including the topic, content, and any images of the doubt, to be provided at least two (2) days in advance.
  • The Academy may combine tutoring sessions for multiple Students where it deems necessary, and reserves the right to reschedule a tutoring session as necessary.
  • The Academy reserves the right to decline to conduct a tutoring session where the doubt relates to a topic scheduled to be taught in a succeeding Session.
  • Tutoring sessions are not available in Offline mode.
Trial Classes and Offers
  • Trial classes (“Demos”) are chargeable in accordance with the fee schedule applicable to the relevant course or course bundle. A Student may avail a particular course or course bundle trial offer only once in a lifetime.
  • A trial may only be availed by a Student not already enrolled in the relevant course.
  • Trial classes cannot be deferred, and the date fixed for attendance is final. Upon expiry of the trial period, the Student may continue attending only upon payment of the fee for the remaining Sessions of the relevant Term or year.
  • The trial fee paid shall be deductible from the Term or annual fee payable for the relevant course or bundle. Where trial classes are taken for more than one course but admission is subsequently taken in only one, the deduction shall apply only to the course in which admission is taken.
  • A deduction under Clause 15.4 may only be availed within the same academic Term or year in which the trial was taken, and cannot be deferred to a subsequent year.
  • The fee for one course bundle is applicable to one Student only, and a course bundle cannot be shared between Students.
  • Payment for a trial class shall not be construed as, or considered a guarantee of, admission.
  • Where a trial period ends before the next Term begins, classes falling between the end of the trial and the commencement of the next Term shall be chargeable on a per-session basis, and the trial fee shall not be deductible against such classes.
Study Material
  • All study material provided by the Academy is complimentary in nature.
  • All such material is, and shall remain, the copyrighted intellectual property of the Academy. No part of any publication of the Academy may be reproduced, distributed, or transmitted in any form or by any means, including photocopying, recording, or other electronic or mechanical means, and all forms of plagiarism or copying are prohibited. The Academy reserves the right to take any measures it deems necessary to prevent plagiarism.
  • Admission may be cancelled where any Student or Parent is found photocopying, photographing, or otherwise reproducing or transmitting such material by any means. Taking pictures of, or distributing or sharing, worksheets on any social media or messaging platform shall result in immediate termination of admission. Where an admission is cancelled, no further study material shall be provided to the Student.
  • A workbook photocopied from another student shall not be permitted in class; each Student must carry an original workbook. Where a Student is found in possession of photocopied material, the admission of both the Student whose workbook was copied and the Student who copied it shall be cancelled, with no claim to a refund.
  • Workbooks are supplied only in accordance with the Student's current mode of learning; a Student moving from Offline to Online mode, or vice versa, shall not be entitled to the workbook applicable to the other mode. Where a Student is assigned a new Level following a revaluation, such change shall take effect only upon completion of the Student's current workbook, save that a Parent wishing to implement the change earlier may do so upon payment of the fee applicable to a replacement workbook for the new Level, in accordance with the prevailing fee schedule.
  • The Student shall complete and submit homework within the stipulated time; submission shall not be accepted after such time has expired. Where a Student misses a Session, it shall be the Student's responsibility to complete the related homework by attending an alternate session or viewing the corresponding recorded Session.
  • The deadline for submission of homework for Online classes shall be communicated to the Parent through Google Classroom; no other mode of homework submission is available.
  • The Academy does not provide answer keys for classwork or homework to Parents or Students, nor does it provide digital copies of its classroom material to Students, for any reason.
  • It is the Parent's and Student's responsibility to ensure the Student brings the correct workbook and learning material to each Session. The Academy does not provide a replacement set of material where a Student attends without their workbook; it shall be the Parent's responsibility to ensure the Student completes any resulting missed classwork at home.
  • Where the Parent opts to have physical study material shipped, the cost of such shipping shall be paid in advance of dispatch. Couriers shall only be sent to the address provided by the Parent in the Academy's prescribed form.
  • Where the Parent does not opt for shipping and instead intends to collect physical study material from a centre, it shall be the Parent's responsibility to ascertain, and to inform the Academy, whether the Parent's location has a centre available for collection; the Academy shall not be obliged to verify, for every Student enrolled in Online mode, whether that Student's location corresponds to a centre offering collection facilities.
  • Any change of shipping address must be communicated to the Academy at least forty-five (45) working days prior to the material being dispatched. Where an address change is not so communicated and material is consequently dispatched to the Parent's previous address, the Parent shall either collect the material from that address or pay for a second courier to be dispatched to the correct address; the Academy shall not be responsible for any resulting delay in delivery, and the courier to the corrected address shall only be dispatched once the original, misdirected courier has been returned to, and received by, the Academy.
Kit
  • It is mandatory for the Student to wear the T-shirt provided as part of the kit, for both Online and Offline classes; a Student not wearing the T-shirt shall not be permitted to attend a Session. Where a Student is unable to wear the T-shirt, the Parent must submit a signed note to that effect, whether through the Academy's prescribed form or on a separate sheet.
  • A complete kit is provided only once per admission, per year. Additional parts of the kit may be purchased at an additional cost, and replacement of any lost or damaged part shall be chargeable, in each case in accordance with the fee schedule for that year, available from the relevant centre head.
  • For a Student enrolled in Online mode, it shall be the Parent's responsibility to collect the kit within the stipulated time, or to opt for courier delivery in accordance with Clause 16 (Study Material).
Pickup and Drop-off (Offline Classes)
  • Parents and Students must strictly adhere to the pickup and drop-off timings notified for offline classes. Parents/guardians should arrive five (5) minutes before a Session is scheduled to end, and must pick up the Student within ten (10) minutes of the Session ending; the Academy shall bear no responsibility for the Student beyond this ten (10) minute period.
  • The centre shall open only ten (10) minutes prior to the scheduled start time of a Session.
  • For a first instance of delayed pickup: a fine of INR 500 shall apply where pickup is delayed beyond 7:45 PM up to 8:00 PM, and a fine of INR 1,000 shall apply where pickup is delayed beyond 8:00 PM.
  • For a second instance of delayed pickup: a fine of INR 1,000 shall apply where pickup is delayed beyond 7:45 PM up to 8:00 PM, and a fine of INR 2,000 shall apply where pickup is delayed beyond 8:00 PM.
  • A Student shall not be permitted to attend further classes until any fine levied under this Clause has been paid.
Official Communication Channels
  • The Academy's primary official channel for communicating schedules, updates, and other information to the Parent is the Google Classroom application, access to which is provided upon enrollment. The Parent is responsible for regularly checking Google Classroom for updates.
  • WhatsApp is used by the Academy as a secondary/backup channel of communication only. Owing to periodic message-delivery restrictions imposed by the messaging platform, WhatsApp messages sent by the Academy may not always be delivered; the Academy shall not be liable for the Parent's non-receipt of any WhatsApp communication, and the Parent is advised not to rely on WhatsApp as the sole source of updates.
  • Email and the Academy's official website (littlegeniusacademy.co.in) shall also be used, as necessary, for official communication.
  • The Academy's Facebook and Instagram handles (@LittleGeniusOnline) are not used by the Academy to disperse official updates or information. These handles are listed solely so that the Parent may verify the authenticity of any account or handle claiming to represent the Academy; the Academy shall bear no liability in respect of any information, communication, or representation received by the Parent through any handle other than the officially listed handle.
  • The Academy may be contacted by telephone during business hours of 11:30 AM to 7:00 PM, Monday to Saturday only; queries shall not be entertained outside these hours. Where the Parent is unable to reach the Academy, or the Academy is unable to attend to a call, the Parent is requested to leave a message via WhatsApp or SMS.
  • The Parent shall ensure that the Academy has the Parent's current primary and secondary phone numbers on record. Where two or more siblings are enrolled with the Academy, a distinct primary number shall be provided for each.
  • The Academy's centres do not maintain dedicated telephone lines; all telephonic queries are handled through the Academy's central line, which is equipped to address all such queries.
Media Release
  • The Academy reserves the right to photograph and record video of activities and teaching conducted in class, and to use such media for publicity and advertising purposes. The Academy further reserves the right to use any media, including photographs and videos, submitted by the Parent, for promotional and advertising purposes.
  • The Parent grants the Academy explicit permission to use photographs and videos of the Student taken during the period of the Student's enrollment, for any lawful purpose, including publicity, copyright purposes, illustration, advertising, and web content. The Parent acknowledges that such material may be electronically displayed via the internet or in a public educational setting.
  • There shall be no time limit on the validity of this release, and no geographic limitation on where such material may be distributed. No royalty, fee, or other compensation shall be payable to the Parent or Student by reason of any such use.
Force Majeure, Pandemic, and Emergency Provisions
  • Where an offline Session is cancelled on account of a natural calamity or other event beyond the Academy's reasonable control, such Session shall not be conducted during the week in which it was originally scheduled, but shall instead be conducted during the following week, in accordance with the Student's regular class schedule.
  • Where a Session is rescheduled under Clause 21.1, the end date of the relevant Term or Level shall correspondingly be extended by the period of the delay (ordinarily one week), so as to ensure that the total number of Sessions promised to the Student for that Term or Level is conducted in full.
  • Where a natural calamity or similar event prevents the conduct of offline Sessions, the Academy may, at its discretion, conduct the affected Sessions in Online mode instead.
  • Where a Session is moved to Online mode under Clause 21.3, no refund, whether full or partial, shall be provided in respect of the fee paid for Offline delivery, on account of such change of mode.
  • No refund shall be provided where a change in the timing of a Session, made in accordance with these Terms, is not suitable to the Parent.
  • During any period in which the Academy conducts Offline classes subject to pandemic-related or similar public health protocols, the following shall apply, in addition to the other provisions of these Terms:
    • parents and guardians shall not be permitted inside Academy centres;
    • Parents and Students must wear masks at all times; a Parent found dropping off a Student without a mask shall have that Student's admission immediately converted to Online mode;
    • a Parent who attempts to force interaction with, or entry into, a centre shall have the Student's admission immediately converted to Online mode;
    • only Students whose Parent or guardian has signed the Academy's consent form for such protocols shall be permitted into a centre;
    • Parents shall not be permitted to meet or speak with any member of the Academy's team at a centre; all communication with the Academy's team shall be conducted electronically;
    • the temperature of Students shall be checked upon entry to a centre; a Student found to have an abnormal or high body temperature shall not be permitted into the classroom, shall be collected by the Parent immediately, and shall not be permitted to return to the centre without a negative disease report, during which period the Student may attend Online Sessions;
    • where the Academy is required to close its centres by government guidelines or on account of a further wave or resurgence, Students shall be required to shift to Online classes; batch selection in such event shall be subject to availability, Online batch timings may differ from the corresponding Offline timings, and no claim to a refund of any fee shall arise on this account;
    • a Parent electing to move a Student from Offline to Online classes shall be granted admission to an Online batch subject to availability, with no claim to a refund of any fee on this account; and
    • Parents and guardians must submit proof of both doses of vaccination before a Student is granted admission to Offline classes, where such requirement is in force.
  • During any declared public health emergency or other exigency, the Academy may, in addition to Clause 21.6, adopt further supplementary protocols (which may include, without limitation, slot-booking arrangements for centre visits, or supplementary live briefing sessions or orientations for Parents) as it deems necessary. Any such supplementary protocol shall be communicated to Parents separately, as and when applicable, and shall not, unless expressly stated, form part of the standing terms set out herein.
  • If any mishap occurs on the Academy's premises, or during an Online Session, on account of circumstances beyond the Academy's reasonable control or any natural calamity, the Academy shall not be responsible in any manner whatsoever. Parents and Students opting for Offline classes are deemed to consent to the Academy's safety guidelines and agree to take all reasonable precautions against illness.
Teacher Allocation and Academic Assessment
  • The Academy employs several qualified teachers. Teachers may change between, or across, Sessions, and no particular teacher is assigned to teach a specific class or Level.
  • The Academy conducts periodic evaluation of a Student's performance by way of tests. The Parent shall ensure that the Student is prepared for such tests. Test scores shall be used as a criterion for promotion of the Student to the next Level, and the Student may, at the teacher's discretion, be asked to repeat or descend a Level.
General Conduct and Termination
  • Disregard, non-confirmation, or non-adherence to these Terms shall lead to immediate termination of the Student's admission.
  • Admission of a Student whose Parent or guardian misbehaves with a member of the Academy's team shall be immediately cancelled, with no claim to a refund of fee; the decision of the Academy's Directors in this regard shall be final and binding.
  • No telephone number of any staff member or faculty shall be shared with any Parent or guardian.
  • The Academy does not assume responsibility for belongings brought by Students or Parents to a centre or class; it is the Student's and Parent's responsibility to ensure that belongings are not misplaced.
  • The Student is a minor and is not a party to these Terms. The Parent is the contracting party for all purposes under the Indian Contract Act, 1872, and shall be responsible and liable for the Student's conduct and for any act, omission, or breach of these Terms by the Student, whether or not the Parent was personally present or complicit in such conduct.
Limitation of Liability
  • Save as expressly set out in these Terms, the Academy's aggregate liability to the Parent in respect of a Program shall not exceed the fees actually paid by the Parent for the relevant Term or Package.
  • The Academy shall not be liable for any indirect, incidental, or consequential loss or damage arising out of or in connection with a Program.
  • The Academy does not stand in loco parentis to the Student, and nothing in these Terms shall be construed as creating any such relationship or as imposing upon the Academy the duties of a guardian. Where the Student attends Offline classes, the Academy shall not be liable for any injury, accident, or harm suffered by the Student on the Academy's premises or elsewhere, arising from circumstances beyond the Academy's reasonable control, including the acts of third parties or any cause not attributable to the Academy's negligence; the Parent shall bear responsibility for the Student's safety and supervision outside the classroom environment.
Amendment
  • The Academy reserves the right to amend or revise these Terms at any time. The revised Terms shall take effect upon publication on the Academy's website, and the Parent's continued enrollment in a Program following such publication shall constitute acceptance of the revised Terms.
Waiver
  • No failure or delay by the Academy in exercising any right under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right preclude any other or further exercise of that or any other right.
Severability
  • If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.
Entire Agreement
  • These Terms constitute the entire agreement between the Parent and the Academy in relation to the relevant Program and supersede all prior understandings, whether written or oral, relating to the subject matter hereof.
Notices
  • Any notice or communication required to be given under these Terms shall be deemed validly given if sent to the Parent's registered email address or phone number on record with the Academy, or to the Academy's official contact details published on its website.
Data Privacy
  • The Academy collects and processes personal data of the Parent and the Student — including name, contact details, address, academic and attendance records, and payment information — solely for the purposes of administering admission, delivering the Program, official communication, and compliance with applicable law.
  • As the Student is a minor, any collection or processing of the Student's personal data by the Academy is undertaken on the basis of the Parent's consent, given at the time of admission and continuing for the duration of the Student's enrollment.
  • The Academy shall not sell or rent the Parent's or Student's personal data to any third party. The Academy may share such data with its service providers, including payment gateway, cloud storage, and communication platform providers, solely to the extent necessary to operate the services described in these Terms.
  • The Academy shall retain personal data only for so long as necessary to fulfil the purposes set out in this Clause, or as required by applicable law.
  • The Parent may, at any time, request the Academy to review, correct, or update the Student's personal data on record, by writing to the Academy's official contact details published on its website.
Grievance Redressal
  • Any grievance, complaint, or concern regarding these Terms, the Program, or the Academy's services may be raised by the Parent in writing at information@littlegeniusacademy.co.in.
  • The Academy shall endeavor to acknowledge and address any such grievance within a reasonable time.
Governing Law and Dispute Resolution
  • These Terms shall be governed by and construed in accordance with the laws of India.
  • The parties shall endeavor to resolve any dispute arising out of or in connection with these Terms amicably. In the event such dispute remains unresolved, it shall be subject to the exclusive jurisdiction of the courts at Vadodara, Gujarat.
